(business name) and can be used only with the express permission of the copyright holder, and the trademark and\/or design rights holder. \u017dIVA HRANA d.o.o. (business name) allows the use of services and content of the website greendrop.com.hr as regulated by these Terms of Purchase (Preliminary Notices).<br><\/p>\n\n\n\n<p>These Terms of Purchase (Preliminary Notices) are part of the Seller&#8217;s obligation in accordance with the provisions of the Consumer Protection Act, and serve to inform the Buyer in a clear and understandable manner about a series of circumstances important for the conclusion, execution, termination of the contract, all in accordance with the legal regulation.<br>The term Seller refers to \u017dIVA HRANA d.o.o., Zatonskih branitelja 31, 22215 Zaton \u0160ibenik, VAT 48765420395, mob 099 2788344, ante.sadaiovdje@gmail.com, (business name, address, VAT, phone number, e-mail address).<br><\/p>\n\n\n\n<p>The term Buyer primarily refers to the classic consumer protected by the Consumer Protection Act, i.e. a natural person who orders and pays for any product through the services of an online store present on the Seller&#8217;s website, but also to buyers who are craftsmen, individual traders and natural persons who conduct business activities, who are protected by the provisions of the Consumer Protection Act only if they buy products unrelated to their business activities, and to all other buyers.<br><\/p>\n\n\n\n<p>The Seller sells through the Internet site greendrop.com.hr in its own name.<br><\/p>\n\n\n\n<p>The Terms of Purchase (Preliminary Notices) form part of the distance contract together with the specifications and price(s) of the purchased product(s), and before confirming the order for the purchase of a particular product, the Buyer will be asked to accept\/declare that he\/she is familiar\/agrees with them, while after confirming the order (concluding the contract), they will be sent to the Buyer as the content of an e-mail message confirming that the contract has been concluded. The Seller reserves the right to change the terms at any time, with the said changes taking effect after being published on these websites.<br><\/p>\n\n\n\n<p>When the Buyer confirms and executes the order, the contract is concluded, and the Seller will immediately inform by e-mail message that the contract has been concluded.<br><\/p>\n\n\n\n<p>For a validly concluded contract, it is necessary that the Buyer is a person who has full business capacity.<br>The Buyer is responsible for the completeness and truthfulness of the data entered during registration.<br>The Terms of Purchase (Preliminary Notices) are divided into the categories\/information listed below.<br>Access to the website greendrop.com.hr may sometimes be unavailable due to work, maintenance or the introduction of new content, as well as in cases of unforeseen circumstances that are beyond the control of the Seller, which the Seller will strive to eliminate as soon as possible.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Main characteristics of goods<br><\/h2>\n\n\n\n<p>Main characteristics of goods: products are presented descriptively and with photos.<br>Product photos are of illustrative nature and may not always correspond in all details to the products that are the subject of the order. The Seller particularly emphasizes that the visual identity of the product shown in the photo does not have to correspond to the appearance of the product in reality, especially considering the settings of the monitor on the customer&#8217;s computer, differences in the perception of colors as seen by the Buyer on the screen, etc. In case of the above-mentioned discrepancy between the product shown in the photo and the delivered product, it is not a product defect.<br>Information about products (product description, price, etc.) displayed on the website greendrop.com.hr is subject to bugs, irregularities in the operation of the application, other technical irregularities, typographical errors, etc. In case of obvious errors or malfunctions regarding the information about products displayed on greendrop.com.hr, the seller reserves the right to unilaterally terminate the contract.<br><\/p>\n\n\n\n<p>The subject of the order can only be products for which it is indicated in the order that they are _available_ it may happen that the information about the availability of the product does not coincide with the warehouse status.<br>If the ordered product is not available in the warehouse, the Seller will inform the Buyer that the product is currently not available, the period in which the product is available, and at the same time offer the possibility of buying an alternative product from the _assortment_ that is available for delivery and that is closest in characteristics to the product that cannot be delivered.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Product price<br><\/h2>\n\n\n\n<p>Prices listed on the website greendrop.com.hr are expressed in kuna with VAT included as the VAT cost is included in the product price. The prices of the products do not include delivery costs and for this reason, they are paid separately, all in accordance with the terms and in the manner indicated by these Terms of <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Purchase (Preliminary Notices).<br><\/h2>\n\n\n\n<p>Before confirming the order, the price of the product in which VAT is included, the delivery price if chargeable, and the final price are separately stated so that the Buyer can see the final price he\/she pays for the ordered service of purchase.\u00a0<\/p>\n\n\n\n<p>In case of payment by e-banking and general payment slip, the costs of payment and\/or interbank transactions are not included in the price.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Shipping Costs<br><\/h2>\n\n\n\n<p>Delivery is carried out via DPD Croatia courier service to the address you specified when purchasing (please note that when purchasing you can define a delivery address different from the address that will appear on the invoice). Since delivery is carried out via DPD Croatia (name of the delivery service) exclusively within the Republic of Croatia, the cost of delivery is fixed at _4.70\u20ac_, and is communicated to the customer when creating an order for all products within the same basket before confirming the order.<br>In case of inability to deliver properly to the Buyer&#8217;s address indicated by the same, the Buyer bears the costs of re-delivery to the same or another address depending on the data that the Buyer will provide to the Seller when checking the delivery of the order.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Costs of using means of remote communication<br><\/h2>\n\n\n\n<p>The Seller has no additional costs of remote communication means.<br>Terms and deadlines for payment, terms of delivery of goods, delivery time of goods<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Terms of Business<br><\/h2>\n\n\n\n<p>These terms apply to adults and business-capable persons residing in the territory of the Republic of Croatia. By ordering and sending an order, you fully agree to these terms.<br>All prices are in euros and include VAT. In case of incorrectly entered price, we reserve the right to change with prior notice to the customer. Minor deviations in the appearance of the product in relation to its image are possible (we have tried to note these differences in the product description).<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to buy?<br><\/h2>\n\n\n\n<p>At \u017dIVA HRANA d.o.o. (business name), in addition to our website, you can also shop personally by coming to our location, which is located at Zatonskih branitelja 31, 22215 Zaton \u0160ibenik; and Zapadna magistrala 1d, 22000 \u0160ibenik.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Online purchase on our website:<br><\/h2>\n\n\n\n<p>In our web store, it is possible to view and order all products from the offered assortment. You can make a purchase or order products as a registered or unregistered customer. If you register before (or during the purchase), you enable us to send our promotional letter to your e-mail address with the latest offers and benefits we offer to our clients.<br><\/p>\n\n\n\n<p>Products are ordered by selection, using the menu, and filling out the electronic form. The product is considered ordered when the customer goes through the entire order process.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ordering process<br><\/h2>\n\n\n\n<p>&#8211; After reviewing the product, type the desired quantity in the window (you can change the quantity later) and click on the text &#8220;Add to cart&#8221;. A dialog will open where you can make or continue shopping. You pay according to the offer you will receive at your e-mail address, not according to the offer that will be displayed on the screen after the purchase, since the offer you receive by e-mail is checked and updated according to the warehouse status. The delivery price will also be highlighted on the offer. You make the payment to our transaction account in HPB Croatian Post Bank (name of the bank), IBAN: HR26 2390 0011 5002 1866 9 (account number), and after the visible payment on the statement, we send the products via DPD Croatia (delivery service) within two days.<br>&#8211; Cash payment or payment on delivery when you pay to the postman upon delivery. Note: when paying on delivery, we send the products immediately upon receipt of the order, and be aware that DPD Croatia (delivery service) may also charge a cash collection service.<br>In the event that the payment is not made within the specified period, the Seller will act and after the payment made outside the delivery period by delivering the purchased products, and if he is unable to deliver for justified reasons, the contract will be unilaterally terminated and a refund of the paid funds will be made.<br>If the payment is duly made and visible on the Seller&#8217;s account, the Seller will proceed with the delivery of the ordered products. The invoice for the order is delivered in the shipment together with the goods.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Delivery conditions<br><\/h2>\n\n\n\n<p>Ordered products are delivered exclusively in the territory of the Republic of Croatia (state, region or city only). Delivery is made via DPD Croatia (delivery service).<br>We deliver goods (which are available in the warehouse) within 1 to 3 working days (delivery time period) where organized delivery is available, directly to the specified address. Where there is no organized delivery, DPD Croatia informs you about the arrival of the shipment that you can pick up at another location available to DPD Croatia (delivery service).<br><\/p>\n\n\n\n<p>If there is an impossibility of delivery of the selected product because the product is no longer available, the Seller is obliged to immediately inform the Buyer, and the Buyer has the right to terminate the contract and request a refund or agree to a subsequent delivery period. All ordered items will be tried to be delivered in one package. If this will not be possible due to stock status, the Seller reserves the right to deliver in several shipments.<br><\/p>\n\n\n\n<p>Delivery is made in accordance with the terms of use of the delivery service, and is considered executed at the moment of handing over the product to the delivery service.<br>When the Seller delivers the product to the Buyer via the delivery service, the Buyer is obliged to accept it by signing on the delivery note, thereby confirming that the product has been properly delivered.<br>In case the Buyer orders goods and refuses to receive them, the Seller has the right to deduct from the paid amount of the purchase price the amount in the amount of delivery costs and other handling costs from the delivery price list.<br><\/p>\n\n\n\n<p>Delivery deadlines do not include:<br>&#8211; the day of receipt of the order\/request<br>&#8211; delay time due to incorrect and incomplete address of the Buyer<br>&#8211; delay time due to force majeure or other reasons for which the Seller is not responsible<br>&#8211; non-working days if they represent the beginning or end of the period<br><\/p>\n\n\n\n<p>In case the ordered product is paid on delivery, the Seller will proceed with the delivery of the goods according to the above deadlines running from the confirmation of the order, and the Buyer is obliged to make a payment during or before the direct receipt of the product.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Privacy of data<br><\/h2>\n\n\n\n<p>Your data, which you voluntarily provide during the registration process, will be used during the purchase process and for sending promotional letters and other informative materials that we provide to our clients. By registering, you express your consent to this practice. The data you give us during anonymous purchase will not be stored for further use.<br><\/p>\n\n\n\n<p>We protect your personal data in accordance with the regulation on the protection of personal data. You have the right to request correction, change or supplement of incomplete or outdated data, and if you do not want to receive informative information from us, you can request it by e-mail or by phone.<br>\u017dIVA HRANA d.o.o. (business name) undertakes to provide protection of personal data of customers, in a way that collects only necessary, basic data about customers \/ users that are necessary to fulfill our obligations; informs customers about the way of using the collected data, regularly gives customers the possibility to choose about the use of their data, including the possibility to decide whether they want their name to be removed from the lists used for marketing campaigns. All user data is strictly kept and available only to employees who need this data to do their job. All employees of \u017dIVA HRANA d.o.o. (business name) and business partners are responsible for respecting the principles of privacy protection.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Unilateral Termination of Contract<br><\/h2>\n\n\n\n<p>Only the Buyer who has concluded the Contract remotely in the manner described above has the right, without stating reasons, to unilaterally terminate the contract within 14 days. The 14-day period begins to run from the day when the goods that are the subject of the contract are handed over to the Buyer or a third person designated by the Buyer, who is not the carrier\/deliverer. If the Buyer has ordered multiple pieces of goods with one order to be delivered separately, or if it is a matter of goods delivered in multiple pieces or shipments, the deadline begins to run from the day when the last piece or last shipment of goods is handed over.<br><\/p>\n\n\n\n<p>If the Seller does not inform the Buyer of this right, the Buyer&#8217;s right to unilaterally terminate the contract expires within 12 months of the expiration of the termination period (the 12-month period begins to run after the expiration of the 14-day period provided for regular termination in case of proper notification). However, if the notice of the right to unilateral termination is delivered within 12 months, the right to unilateral termination expires 14 days after the Buyer receives this notice.<br>The Buyer is obliged to notify the Seller of his decision to terminate the contract before the deadline for unilateral termination, using the <a href=\"https:\/\/greendrop.com.hr\/en\/wp-content\/uploads\/sites\/2\/2023\/12\/greendrop-obrazac-en.pdf\">Unilateral Contract Termination Form<\/a>, which he can fill out and send to the email address ante.sadaiovdje@gmail.com (e-mail address) or by mail to the seller&#8217;s address \u017dIVA HRANA d.o.o., Zatonskih branitelja 31, 22215 Zaton \u0160ibenik (business name, address). The Seller will provide confirmation of receipt of the notice of unilateral termination of the contract, without delay, electronically.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Refund<br><\/h2>\n\n\n\n<p>If you unilaterally terminate this Contract, we will refund the money we received from you, without delay, but no later than 14 days from the day we receive your decision to unilaterally terminate the contract. The cost of returning the goods is borne by the Buyer. The refund will be made in the same way you made the payment. We can only make a refund after the goods have been returned to us or after you provide us with proof that you have sent the goods back to us. You are obliged to return the goods to us immediately, and no later than 14 days from the day you sent us your decision on unilateral termination.<br>Return the goods personally or by mail in a provable way to the address \u017dIVA HRANA d.o.o., Zatonskih branitelja 31, 22215 Zaton \u0160ibenik (business name, address). It is considered that you have fulfilled your obligation on time if you send the goods in a provable way (registered with the shipment) personally to us in our warehouse before the expiry of the above deadline.<br>The user acquires the right to a refund also if he does not want a replacement product, and the goods have not been delivered in accordance with the order, the delivered goods do not correspond to the manufacturer&#8217;s specifications, if damage occurred during delivery and if the health safety of the product is suspected.<br><\/p>\n\n\n\n<p>You are responsible for any decrease in the value of the goods resulting from the handling of the goods, other than what was necessary to determine the nature, characteristics and functionality of the goods. If the product is returned defective, with greater damage or without parts and documentation, and if the same is not delivered within a subsequent period of 8 days, it is considered that the Buyer has not fulfilled his obligation to return the goods, and the Seller is not obliged to refund the paid funds.<br><\/p>\n\n\n\n<p>The Buyer does not have the right to unilaterally terminate the contract if:<br>&#8211; the contract for services that the Seller has fully fulfilled, and the fulfillment began with the express prior consent of the Buyer, and with his confirmation that he is aware of the fact that he will lose the right to unilateral termination of the contract from this section if the service is fully fulfilled;<br>&#8211; the subject of the contract is goods or services whose price depends on changes in the financial market that are beyond the influence of the Seller, and which may occur during the duration of the Buyer&#8217;s right to unilateral termination of the contract;<br>&#8211; the subject of the contract is goods made to the specification of the Buyer or which is clearly adapted to the Buyer;<br>&#8211; the subject of the contract is easily perishable goods or goods with a short shelf life;<br>&#8211; the subject of the contract is sealed goods that are not suitable for return for health or hygiene reasons, if it was unsealed after delivery;<br>&#8211; the subject of the contract is goods that, due to their nature, are inseparably mixed with other things after delivery;<br>&#8211; the subject of the contract is the delivery of alcoholic beverages whose price was agreed at the time of conclusion of the contract, and delivery can only follow after 30 days, if the price depends on changes in the market that are beyond the influence of the trader;<br>&#8211; If the buyer specifically requested a visit from the Seller to perform urgent repairs or maintenance work, provided that if during such a visit, in addition to those services that the Buyer expressly requested, the <\/p>\n\n\n\n<p>Seller provides some other services, or delivers some other goods in addition to those necessary for performing urgent repairs or maintenance work, the Seller has the right to unilateral termination of the contract in relation to these additional services or goods;<br>&#8211; the subject of the contract is the delivery of sealed audio or video recordings, or computer programs, which were unsealed after delivery;<br>&#8211; the subject of the contract is the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts for such publications;<br>&#8211; contract concluded at public auction;<br>&#8211; the subject of the contract is the provision of accommodation services that are not intended for housing, the provision of goods transport services, vehicle rental services, food and beverage delivery services or services related to leisure time, if it is agreed that the service will be provided on a specific date or in a specific period;<br>&#8211; the subject of the contract is the delivery of digital content that is not delivered on a physical medium if the fulfillment of the contract began with the express prior consent of the Buyer and with his confirmation that he is aware of the fact that he will thereby lose the right to unilateral termination of the contract;<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Liability for Material Defects \/ Complaints<br><\/h2>\n\n\n\n<p>The Seller is responsible for material defects in the goods it sells on its pages in accordance with the positive regulations of the Republic of Croatia, especially the Obligations Act.<br>The ordered products are packed in such a way that they are not damaged by normal handling in transport\/delivery.<br><\/p>\n\n\n\n<p>In case the shipment is damaged in transport, such damages are visible when receiving the shipment, and in that case, we suggest that the Buyer does not accept the shipment. Please contact us so that we can check the status of the shipment and send a new one as soon as possible.<br><\/p>\n\n\n\n<p>Upon receipt of the goods, the correctness of the order depends on the buyer, and the Buyer is obliged to compare the received items with the invoice, if something is missing he is obliged to immediately send a written complaint\/complaint because subsequent complaints will not be accepted.<br>In case of visible defect of the product upon receipt of the shipment, the Buyer is not obliged to accept the delivered product, can refuse to accept, and does not bear the cost of delivery of such a product.<br>It is considered that the products that were properly received by the Buyer did not have a visible defect.<br><\/p>\n\n\n\n<p>The Buyer has the right to complain in relation to material defects within the deadlines and for the reasons prescribed by the provisions of the Obligations Act. The Buyer can send a written complaint or claim to the e-mail ante.sadaiovdje@gmail.com or by mail to the seller&#8217;s address: \u017dIVA HRANA d.o.o., Zatonskih branitelja 31, 22215 Zaton \u0160ibenik, with the note Complaint. In case of impossibility of delivery in written form, report the complaint by phone to the phone number: 099 2788344. The complaint should contain: a) the name of the article, b) a brief description of the complaint, d) the number of articles to which the complaint relates.<br><\/p>\n\n\n\n<p>Submitted complaints will be processed as soon as possible. Also, for a faster determination of the specific order to which the Buyer has a complaint, Buyers are asked to state the order number, invoice number or their username in the complaint.<br>The Buyer has the right to a justified complaint and return of goods in the following cases:<br>&#8211; if the goods were not delivered in accordance with the order<br>&#8211; if the delivered goods do not correspond to the manufacturer&#8217;s specifications<br>&#8211; if damage occurred during delivery<br>&#8211; if the health safety of the product is suspected<br><\/p>\n\n\n\n<p>If the recipient determines damage to the shipment upon delivery, he is obliged to make a record of the condition of the goods in the shipment, which are jointly certified by the recipient and the driver, and such a document can be the basis for compensation for damage.<br>If the product has a hidden defect (a defect that could not be detected by a regular inspection when receiving the goods) which the Buyer determines upon opening the product &#8211; the Buyer has the right to unilateral termination of the contract and a refund, and replacement of the product.<br><\/p>\n\n\n\n<p>The Seller will otherwise consider the complaint valid if it determines by examining the product that it meets the conditions for a complaint in accordance with the Obligations Act and the Consumer Protection Act. In that case, it will therefore replace the product or refund the entire paid amount by terminating the contract within 15 days of receiving a valid complaint.
